Synopsis
An in-depth doctrinal examination of the criminal offense introduced into the Child and Adolescent Statute (ECA) for the possession and storage of child and adolescent pornography in digital media. The author confronts the legislative technique with Günther Jakobs’s theory of Enemy Criminal Law, inquiring whether the criminalization of preparatory acts and of mere possession violates the principles of harm, culpability and offensiveness in a democratic State governed by the rule of law.
