Investigação Criminal Cibernética

[Cyber Criminal Investigation]

Toward a criminal policy for the protection of children and adolescents on the internet

A pioneering work forming part of the established Coleção Investigação Criminal [Criminal Investigation Collection] (Volume 6). The book examines in depth the intersection between Criminal Procedure, the fundamental guarantees of the 1988 Federal Constitution, and the operational and doctrinal challenges of combating the sexual exploitation of children and adolescents in the cyber environment. It addresses modern techniques of digital criminal investigation, the collection and preservation of telematic evidence, transnational police cooperation, and the pressing need to formulate a contemporary criminal policy that is technically oriented and grounded in humanistic values.

O Futuro da Persecução Penal no Ciberespaço

[The Future of Criminal Prosecution in Cyberspace]

Advanced Studies in Cybercrime

Cyberspace is no longer a marginal or merely instrumental space; it has become a central dimension of contemporary crime, affecting the definition of legally protected interests, the shaping of criminal offenses, the methods of criminal investigation and the very foundations of due process of law. The book starts from the premise that tackling crime in cyberspace cannot be understood merely as a technological issue, but as a complex legal and criminal phenomenon that requires an integrated reading of Criminal Law, Criminal Procedure, Criminology, Criminal Policy and Computer Science. The result is a cohesive work that reflects the commitment of the National Police Academy (ANP) to producing applied, critical knowledge aligned with the real challenges of public security in a network society.

Ciencia Policial: Fundamentos de la Seguridad Pública

[Police Science: Foundations of Public Security]

by Jairo Enrique Suárez Alvarez — the first title published by ANP Editora, under the editorial direction of Stenio Santos Sousa

The work with which ANP Editora began its publishing activity, in 2021, under the direction of Stenio Santos Sousa as Responsible Editor and Executive Council Member. The Colombian author Jairo Enrique Suárez Alvarez — a member of the editorial board of the Revista Brasileira de Ciências Policiais — argues, over sixteen chapters, that police power is the core concept for understanding the role of the modern State in matters of public security, and that the rule of law must develop its own science: police science, conceived as a new social science of the State whose purpose is peaceful coexistence. The book traces the old police science of Johann Heinrich Gottlob von Justi, its Latin American continuation in Enrique Fentanes and the Colombian tradition, and closes with the ontological, teleological, gnoseological and methodological foundations of the field. Foreword by Eliomar da Silva Pereira.

As operações da Polícia Federal e as influências políticas

[Federal Police Operations and Political Influences]

A manifesto for separating the Department of Federal Police from the Executive Branch

Selected by the editors of Revista Jus Navigandi as an Editors’ Pick, the article starts from the 2005 Federal Police operations that reached politicians and the economic elite, such as Narciso, Cevada and Confraria, and from the criticism that accompanied them in the context of the Correios Parliamentary Inquiry Committee (CPI dos Correios), in order to address the suspicion that the institution served the interests of the government. The author, then a Federal Police Delegate and a graduate student in Criminal Sciences, argues for the legality of the investigative instruments employed and the qualifications of the personnel trained by the Academia Nacional de Polícia (National Police Academy), and concludes in favor of creating a body separate from the Federal Executive, with express constitutional guarantees for Federal Police Delegates, in particular functional independence and irremovability.

Foro por Prerrogativa de Função

[Special Forum by Prerogative of Office]

Procedures in the course of the preliminary criminal investigation

A text derived from the monograph concluding the Specialization in Criminal Sciences (UNAMA/UVB/Rede LFG), published in the inaugural issue of Revista Criminal: ensaios sobre a atividade policial. The essay examines the possibilities and scope of the preliminary criminal investigation and its influence on criminal proceedings, starting from the divergences in legal scholarship and case law on the special forum by prerogative of office (foro por prerrogativa de função) during the police investigation (inquérito policial): whether the prerogative should be restricted to criminal proceedings and whether the police authority may open the investigation without prior authorization from the competent court. It concludes that the weak point of the Brazilian model lies not in the separation between investigating, prosecuting and judging, but in the lack of guarantees for police authorities and of a defined constitutional place for the judicial police, which should have full autonomy from the Executive Branch, among the functions essential to Justice.
